Somalia
M.G., born in 1936, took part in the 1969 military coup in Somalia. He became a member of the Supreme Revolutionary Council, before occupying several positions of responsibility. Several times appointed Minister, this close ally of Siad Barre was in particular President of the Criminal Investigation Department from 1971, the year it was founded, up until 26th January 1991, date of the collapse of the Barre regime.
Under his presidency, the Criminal Investigation Tribunal, for example, condemned to death a Minister, a member of the Revolutionary Council and a senior officer accused of plotting against the revolution. The sentence was carried out .In 1975, 11 people were condemned to death and executed for having organised strikes of a political and religious nature, by a judgement rendered by this same Criminal Investigation Tribunal, and still under the Presidency of M.G.
Having fled Somalia, he applied for asylum in Switzerland with his family. In view of the crimes committed by M.G. he was considered ineligible to obtain asylum by a decision of the Federal Office for Refugees on 19th May 1994, and was to be expelled from Switzerland. On appeal the Swiss Appeal Commission (CRA) declared that M.G. had committed imprescriptible crimes which made him ineligible to obtain asylum in Switzerland. Nevertheless, in view of the serious risk that his life was in danger were he to be sent back to his country , he was granted temporary admission (see decision of CRA of 14th May 1996, in French).
M.G. has never been prosecuted in Switzerland for the crimes he committed.
