A warrant of arrest was first issued against Ntaganda on 22nd August 2006 by the Pre-Trial Chamber I of the International Criminal Court (ICC) but was kept under seal due to the risk of Bosco Ntaganda fleeing or obstructing the work of the Court.

The warrant was unsealed on 28th April 2008 upon the request of the Prosecutor.

According to the Arrest Warrant Bosco Ntaganda is accused to be criminally liable under article 25 (3) (a) of the Statute of the International Criminal Court for the following war crimes:

(i) enlistment of children under the age of fifteen punishable under article 8 (2) (b) (xxvi), or article 8 (2) (e) (vii), of the Statute;

(ii) conscription of children under the age of fifteen punishable under article 8 (2) (b) (xxvi) or article 8 (2) (e) (vii), of the Statute; and

(iii) using children under the age of fifteen to participate actively in hostilities punishable under article 8 (2) (b) (xxvi), or article 8 (2) (e) (vii), of the Statute;

Ntaganda is still at large in Congo.

The Prosecutor Luis Moreno-Ocampo has requested that “all concerned States authorities and actors contribute to his arrest and surrender him to the Court”.
