Charged with counts 1 (common plan or conspiracy), 2 (crimes against peace), 3 (war crimes) and 4 (crimes against humanity), he pleaded not guilty.
His defence, for the most part, consisted in denying the contents of the documents or depositions put before the International Military Tribunal in Nuremberg. In his position as the highest ranking officer of the RSHA after the death of Himmler and Heydrich, his task was not so easy and the Tribunal was not convinced.
On 1 October 1946, Ernst Kaltenbrunner was found guilty as charged of the crimes committed under the indictments No 3 and 4.
His appeal to the Control Council was rejected on 10 October 1946.
Ernst Kaltenbrunner was executed by hanging on 16 October 1946.
