Germain Katanga, who was previously held at the Penitentiary and Reeducation Center of Kinshasa (CPRK), Democratic Republic of Congo, since March 2005, was surrendered by the Congolese authorities and transferred to the International Criminal Court in The Hague, Netherlands, on 17 October 2007. A sealed warrant of arrest for him had been issued by the Pre-trial Chamber I of the ICC on 2 July 2007. The warrant was unsealed on 18 October 2007.

Germain Katanga is accused of being responsible under article 25-3-a or 25-3-b of the Rome Statute of six counts of war crimes and three counts of crimes against humanity:
-«wilful killing as a war crime» (articles 8-2-a-i or 8-2-c-i of the Statute);
-«inhumane treatment as a war crime» (articles 8-2-a-ii of the Statute) or «cruel treatment as a war crime» (article 8-2-c-i of the Statute);
-«using children under the age of fifteen years to participate actively in hostilities as a war crime» (articles 8-2-b-xxvi or 8-2-e-vii of the Statute);
-«sexual slavery as a war crime» (articles 8-2-b-xxii or 8-2-e-vi of the Statute);
-«intentionally directing attacks against the civilian population as such or against individual civilians not taking direct part in hostilities as a war crime» (articles 8-2-b-i or 8-2-e-i of the Statute);
-«pillaging a town or place, even when taken by assault as a war crime» (articles 8-2-b-xvi or 8-2-e-v of the Statute);
-«murder as a crime against humanity» (article 7-1-a of the Statute);
-«other inhumane acts as a crime against humanity» (article 7-1-k of the Statute);
-«sexual slavery as a crime against humanity» (article 7-1-g of the Statute).

His initial appearance was held on Monday 22 October 2007.

On 10 March 2008, Pre-Trial Chamber I decided to join the cases of Germain Katanga and Mathieu Ngudjolo Chui (see "related cases").

In June 2008, the Prosecutor announced to remove the sexual slavery charges from the indictments against Katanga and Ngudjolo (see "related cases").

On 26 September 2008, Pre-Trial Chamber I issued a decision on the confirmation of charges in the case of The Prosecutor v. Germain Katanga and Mathieu Ngudjolo Chui.
