| | | | The former Argentinean Army Officer, Adolfo Scilingo was arrested in Spain in 1997 by judge Garzon, the examining magistrate.
Scilingo was accused of attempted genocide, since the aim of the military regime at the time was to eliminate, systematically, a whole category of people, namely the opponents of the regime. Furthermore, Scilingo was also accused of terrorism and torture.
His trial was opened up on 14 January 2005 in Madrid.
Dozens of witnesses were heard, most of them survivors of the "Dirty War". On 7th of March 2005, the Prosecutor required a punishment of 9138 years of prison for Scilingo.
Scilingo's defence lawyer asked the Court to acquit his client for lack of evidence.
On April 19, 2005, Scilingo was sentenced to 640 years imprisonment.
An appeal was lodged against the decision.
On 4 July 2007 the Spanish Supreme Court increased the prison sentence to 1084 years. The clearest variation from the original judgement is that the application of the penalties has been modified, so that article 607 bis of the current Criminal Code - which punishes crimes against humanity - is not used. The Court applies the specific penalties provided in the current Criminal Code for the crimes of murder and unlawful detention but holds that these crimes “constitute crimes against humanity according to international law.
Accordingly, the effective penalty is limited to 25 years following the maximum limits for enforcement of penalties provided for under article 76.1a) of the current Criminal Code. | | click for more... | | Trial Watch would like to remind its users that any person charged by national or international authorities is presumed innocent until proven guilty. | | | | | last time seen : | | | Madrid (Spain) | | | judgement period : | | | 14.01.2005 - 04.07.2007 | | | charges : | | | Crimes against humanity Genocide Other Torture | | | profile last modified : | | | 07.07.2007 |
