Nsengiyumva was arrested in Cameroon on 27 March 1996 and transferred to the International Criminal Tribunal for Rwanda (ICTR) on 23 January 1997.

Anatole Nsengiyumva was charged based on his individual criminal responsibility (Art. 6 § 1 ICTR Statute) and on his criminal responsibility as hierarchical superior (Art. 6 § 3 ICTR Statute) for:

- Four counts of genocide, of conspiracy to commit genocide, complicity in genocide and direct and public incitement to commit genocide;
- Four counts of crimes against humanity in the context of systematic and generalised attacks against a civilian population on the grounds of its political, ethnic or racial group, for murder, extermination, rape and persecution;
- Two counts of serious violations of Article 3 common to the Geneva Conventions and Additional Protocol 11, for murder and serious violence to the health and physical and mental well being of civilians and for outrages upon personal human dignity in particular by humiliating and degrading treatment, rape and indecent assault.

Anatole Nsengiyumva is being tried in the trial known as the “Military I" together with Théoneste Bagosora, Gratien Kabiligi and Aloys Ntabakuze (see “related cases”).The trial began on 2 April 2002 and is still underway.
