On the 25 February 2004, Ephrem Setako was arrested in Amsterdam and a few days later he was transferred the International Criminal Tribunal for Rwand (ICTR) in Arusha.

On 22 March 2004, the prosecutor of the ICTR indicted Ephrem Setako on six counts:

_ genocide (Art. 2(3)(a) of the Statute of the ICTR) or complicity in genocide (Art. 2(3)(e) of the Statute of the ICTR);
_ crimes against humanity: murder (Art. 3(a) of the Statute of the ICTR) and extermination (Art. 3(b) of the Statute of the ICTR; and
_ war crimes: violence to life, health and physical or mental well-being of persons, in particular murder as well as cruel treatment such as torture, mutilation or any form of corporal punishment (Art. 4(a) of the Statute of the ICTR) and pillage (Art. 4 (f) of the Statute of the ICTR).

On 22 November 2004, Ephrem Setako pleaded not guilty to all the six charges.
The trial before the ICTR started on 25 August 2008.

However, the trial was suspended in September 2008. At that time, 12 of the 21 prosecution witnesses had testified in front of the Tribunal.

On 16 February 2009, the trial restarted. The Prosecutor finished its closing argument on 22 April 2009 whereas the Defense finished on 26 June 2009.

The Tribunal gave its judgment on 25 February 2010.

Setako Ephrem was found guilty of genocide, extermination as a crime against humanity and violence to life as a war crime for ordering the killing of 30 to 40 refugees at the Mukamira military camp, on 25 April 1994.

He was sentenced to 25 years imprisonment.
