Accused of genocide, at large; a request for referral of his case to the Rwandan judiciary was filed on 11 June 2007 by the chief prosecutor for the ICTR
On 2 August 2001, Fulgence Kayishema was accused of genocide, or in the alternative, complicity in genocide, conspiracy to commit genocide and crimes against humanity for extermination. He was charged by the prosecutor for the International Criminal Tribunal for Rwanda.
He is still at large.
On 19 June 2007, the chief prosecutor for the ICTR brought fourth a motion to bring Kayishema’s file before the Rwandan legal system. This is the first time in the Tribunal’s history that the prosecutor brings forth a motion for transfer to Rwanda.
The Rwandan government has expressed its willingness and availability to judge the accused, amidst assurances that he will benefit from a fair trial and that the death penalty will not be applied if he is found guilty (see “spotlight”).
