Goran Jelisic was arrested by the SFOR on 22 January 1998. He was transferred to the ICTY on the same day.

On his initial court appearance on 26 January 1998, he pleaded not guilty to the charges brought against him.

On the basis of the second, modified, act of indictment drawn up on 19 October 1998, Goran Jelisic pleaded guilty to 15 counts of crimes against humanity and to 16 counts of breaches of the laws and customs of war. On the other hand, he pleaded not guilty to the count of genocide.

On 19 October 1999, the Trial Chamber issued an oral verdict in which it acquitted Goran Jelisic on the count of genocide based on Article 98bis of the Rules of Procedure and Evidence. On the other hand, it found him guilty of all of the other 31 counts with which he had been charged. On 14 December 1999, the 1st Trial Chamber rendered its verdict and sentenced Goran Jelisic to 40 years imprisonment for war crimes and crimes and crimes against humanity.

On 21 October 1999, the prosecution, which contested in particular his acquittal on the charge of genocide, lodged an appeal against the oral verdict of 19 October 1999. As for the defence, it filed an appeal against the verdict on 15 December 1999.

On 5 July 2001, the Appeals Chamber confirmed the sentence of 40 years imprisonment handed down by the Trial Chamber.

On 7 January 2002, Goran Jelisic’s Council for the Defence lodged a confidential request for a review of the judgements of the Trial Chamber and Appeals Chamber.
On 2 May 2002, the Appeals Chamber rejected his request.

Goran Jelisic was transferred to Italy on 29 May 2003 to serve out the remainder of his sentence.
