|  | |  | Hashem Ahmed turned himself in on Friday 19 September 2003.
He was then turned over to Iraq's Interim Government on 30 June 30 2004 and was arraigned on the 1 July 2004.
On 19 December 2004, two of Saddam Hussein's former aides, Ali al-Majid and Hashem Ahmed appeared in court. The Deputy Prime Minister Barham Salih claimed Hashem Ahmed had been expected to testify against Ali al-Majid. The Court hearings were not disclosed.
In the second trial before the Iraqi High Tribunal, the Anfal trial, Hashem Ahmed was one of Saddam Hussein's (see "related cases") co-defendants. The trial concerned the Anfal campaign in which around 180'000 Kurd civilians were allegedly killed by poison gas, according to prosecutors.
Hashem Ahmed was charged with war crimes and crimes against humanity.
His co-defendants (see "related cases") were either charged with genocide, crimes against humanity and war crimes (Saddam Hussein and Ali Hassan al-Majid ), or war crimes and crimes against humanity (Hussein Rashid al-Tikriti, Farhan Mutlak al-Jubouri, Sabir Abdul-Aziz al-Duri ). Tahir Tawfiq al-Ani was only charged with crimes against humanity.
The trial began on 21 August 2006.
The presiding judge was replaced on 20 September 2006, after having been accused of bias towards Saddam Hussein. The defence team strictly objected to what they considered an undue interference by the government in the trial.
On 24 June 2007, Hashem Ahmed, Rashid al-Tikriti and Ahmed al-Jubouri were sentenced to death for war crimes and crimes against humanity and Hassan al-Majid for war crimes, crimes against humanity and genocide.
All three convicted men filed an appeal against the judgment on 23 July 2007.
On 21 August 2007, a third trial on charges of genocide and crimes against humanity began against Hashem Ahmed and 14 other accused (among whom Ali Hassan al-Majid, sometimes referred to as “Chemical Ali”.
On 3 September 2007 the Appeals Chamber of the Iraqi High Court confirmed the death sentence against al-Majid and the two others.
The Iraqi President objected to the planned execution of Hashem Ahmed al-Tai , saying he would not approve al-Tai's death sentence and that al-Tai should receive clemency because he was acting under the threat of death from Saddam and had worked with the Kurdish community while he was an official in Saddam's regime. Executions have to be approved by all three members of the Presidential Council, but so far, the Vice-President, Tariq al-Hashimi, a Sunni like Hashem Ahmed, has refused to sign the execution order.
On 3 October 2007 the Iraqi authorities announced their intention to postpone the date of the execution.
At the end of November 2007, the Iraqi Prime Minister Nouri al-Maliki formally asked US President George Bush to hand over Hashem Ahmed al-Jubouri and the two other convicted men immediately.
Earlier the same month, US commanders had said they would not transfer the men to Iraqi custody until they received an "authoritative" request from the Iraqi government.
On 28 February 2008, the three-member Iraqi presidential council agreed to al-Majid's execution, but did not approve death sentences against Hussein Rashid al-Tikriti and Sultan Hashem Ahmed al-Tai.
