| | | | Hormisdas Nsengimana was arrested on 21 March 2002 in Cameroon, after a bill of indictment was issued by the office of the Chief Prosecutor of the International Criminal Tribunal for Rwanda (ICTR) on 8 June 2001.
The indictment charged him on four counts:
- genocide (Art. 2 (3) (a) of the ICTR-Statute)
- complicity to commit genocide (Art. 2 (3) (e) of the ICTR-Statute)
- complicity to commit genocide (Art. 2 (3) (b) of the ICTR-Statute)
- crimes against humanity: murder (Art. 3 (a) of the ICTR-Statute)
- crimes against humanity: extermination (Art. 3 (b) of the ICTR-Statute)
In addition to his individual criminal responsibility (Art. 6 (1) of the ICTR-Statute), Nsengimana was additionally indicted for the fact that he knew or should have known of the acts or omissions of his subordinates and for doing nothing to stop, discourage, sanction or punish the perpetrators (criminal responsibility as hierarchical superior - Art. 6 (3) of the ICTR-Statute).
On 10 April 2002, Nsengimana was transferred to the ICTR in Arusha (Tanzania).
At his initial court appearance on 16 April 2002, he pleaded not guilty to all of the charges laid against him.
His trial began on 22 June 2007.
On 17 November 2009, Nsengimana was acquitted on all charges and set free.
