In the second trial before the Iraqi High Tribunal, the Anfal trial, Hussein Rashid al-Tikriti was one of Saddam Hussein's (see "related cases") co-defendants. The trial concerned the gas campaign against the Kurds in the 1980s.

Hussein Rashid al-Tikriti was charged with war crimes and crimes against humanity.

His co-defendants (see "related cases") were either charged with with genocide, crimes against humanity and war crimes (Saddam Hussein and Ali Hassan al-Majid ), or war crimes and crimes against humanity (Hashem Ahmed al-Jubouri, Sabir Abdul-Aziz al-Duri, Farhan Mutlak al-Jubouri). Tahir Tawfiq al-Ani was only charge with crimes against humanity.

The trial began on August 21, 2006 .

The presiding judge was replaced on 20 September 2006, after having been accused of bias towards Saddam Hussein. The defence team strictly objected to what they considered an undue intereference by the government in the trial.

Saddam Hussein was executed on 30 December 2006, after being sentenced to death for other crimes.

On 24 June 2007 Rashid al-Tikriti, Ahmed al-Juburi were sentenced to death for war crimes and crimes against humanity and and Hassan al-Majid for war crimes, crimes against humanity and genocide.

The five convicted filed an appeal against the judgment on 23 July 2007.

On 13 August 2007, the autorities announced that a third trial on charges of genocide and crimes against humanity against al-Tikriti and 14 other accused (among whom Ali Hassan al-Majid, see "related cases") began on 21 August 2007.

On 3 September 2007 the Appeals Chamber of the Iraqui High Court confirmed the death sentence against al-Majid and the two others.

On 7 September 2007 the Iraqi President objected to the planned execution of Hashim Ahmed al-Tai (see 'related cases'), saying he will not approve al-Tai's death sentence and that al-Tai should receive clemency because he was only acting under the threat of death from Saddam and had worked with the the Kurdish community while he was an official in Saddam's regime. Executions have to be approved by the government and the president's office.

On 3 October 2007 the Iraqi authorities announced their intention to postpone the date of the execution.

At the end of November 2007, the Iraqi Prime Minister Nouri al-Maliki formally asked US President George Bush to hand over the three convicted immediately.
Earlier the same month, US commanders had said they would not transfer the men to Iraqi custody until they received an "authoritative" request from the Iraqi government.

On 28 February, athree-member Iraqi presidential council agreed to al-Majid's execution, but did not approve death sentences against Hussein Rashid al-Tikriti and Sultan Hashim al-Tai. The two will remain in U.S. custody but are under the jurisdiction of the Iraqi government,
