Jean de Dieu Kamuhanda was arrested, at the request of the Prosecutor of the ICTR (International Criminal Tribunal for Rwanda), on 26 November 1999, in Bourges, France. On 7 March 2000, he was transferred to the prison quarters of the United Nations in Arusha, Tanzania.

At his initial court appearance on 24 March 2000, Kamuhanda pleaded not guilty to the 9 counts with which he was charged. Whereas, initially, Kamuhanda had been charged together with 8 other persons, on 7 November 2000 the ICTR decreed a separate trial for Kamuhanda as well as an amendment to the indictment, this being effected on 15 November 2000. His trial opened on 17 April 2001, but as a result of the sudden death of judge Laity Kama, the trial had to be restarted from the very beginning on 3 September 2001 before a Trial Chamber with two new judges.

On 20 August 2002, following a request from the defence council, he was acquitted by the Chamber on the first count of indictment (“conspiracy to commit genocide”), in accordance with the regulations of the ICTR which state that “following presentation of the evidence by the prosecution, if the Chamber concludes that such evidence does not suffice to justify a guilty verdict on one or more of the counts listed in the indictment, then it shall pronounce an acquittal with respect to the counts in question”. After hearing the testimony of many witnesses and a trial lasting 84 days, the Chamber retired on 28 August 2003 to consider its verdict.

On 22 January 2004, the Second Trial Chamber pronounced its verdict and declared, unanimously, that Jean de Dieu Kamuhanda was: guilty of “genocide” (2nd count of indictment) and guilty of “extermination, as a crime against humanity” (5th count of indictment).

Kamuhanda was found not guilty of war crimes and “other inhumane acts as a crime against humanity” and not guilty of “rape as a crime against humanity”.

He was sentenced to life imprisonment, the maximum term provided for by the ICTR.

On September 19, 2005, the Appeals Chamber confirmed this sentence.

On 7 December 2008, he was transferred to Mali where he will serve the remainder of his sentence.
