Initial Indictement - December 22nd 2004 Indictment against Ljube Boskoski and Johan Tarculovski, charged by the Prosecutor of ICTY with 3 counts of violations of the laws or customs of war
Arraigned on 22 December 2004, the proceedings against Johan Tarculovski are based on both his individual criminal responsibility (Art. 7 §1 ICTY Statute) as well as his superior hierarchical responsibility (Art. 7 § 3 ICTY Statute) on three counts of violations of the laws and customs of war, namely:
- murder;
- wanton destruction of towns and villages;
- cruel treatment.
Johan Tarculovski was transferred from Skopje to The Hague on 21 March 2005. At his initial court appearance on 1 April 2005, he pleaded not guilty.
His case was joined with the trial of Ljube Boškoski. This is the only case related to the Macedonian conflict heard by the ICTY.
The trial of Ljube Boškoski and Johan Tarèulovski started on 16 April 2007. The Prosecution completed its
case on 6 December 2007.
The Defence cases commenced on 30 January 2008 and were completed on 18
March 2008.
The closing arguments took place between 6 and 8 May 2008.
On 10 July 2008, the Trial Chamber II sentenced Johan Tarèulovski to 12 years
imprisonment for crimes committed against ethnic Albanians in village of
Ljuboten, near the Macedonian capital Skopje, on 12 August 2001.
Tarculovski appealed the decision on 8 August 2008.
