Juvénal Rugambarara was arrested by Interpol on request of the Chief Prosecutor of the ICTR (International Criminal Tribunal for Rwanda), on 11 August 2003 in Uganda. On 13 August 2003, he was transferred to the ICTR in Arusha, Tanzania.

On 15 August 2003 at his initial appearance before the Trial Chamber, Rugambarara pleaded not guilty to the nine counts with which he was charged.

According to a bill of indictment dated 1 July 2004, Rugambarara was charged on nine counts . He was accused of “genocide” or in the alternative “complicity in genocide”, “conspiracy to commit genocide”, “direct and public incitement to commit genocide”, “extermination as a crime against humanity”, “torture as a crime against humanity”, “rape as a crime against humanity” as well as various war crimes.

On 12 June 2007, after two years of negotiations, an agreement was reached. The Prosecutor filed a request to amend the indictment by withdrawing eight of the original nine counts confirmed against the accused and other factual allegations. The Prosecutor’s request was granted by the Trial Chamber on 28 June 2007.

On 13 July 2007, Rugamabara pleaded guilty to the single count of extermination as a crime against humanity before the Trial Chamber II of the International Criminal Tribunal for Rwanda (ICTR).

The Trial Chamber found Rugambarara guilty of extermination because he failed, in his capacity as Mayor, to take necessary and reasonable measures to commission an investigation into the crimes committed in the commune and to apprehend and punish the perpetrators.

At the sentencing hearing on 16 November 2007, the ICTR sentenced Rugambarara to 11 years imprisonment.
