Momcilo Perisic voluntarily surrendered on 7 March 2005 and was transferred on the same day to the ICTY.
He was charged on the basis of his individual criminal responsibility( Art.7 §1 of the ICTY Statute) and on the basis of his responsibility as hierarchical superior (Art7 §3 of the ICTY Statute) with:
- Eight counts of crimes against humanity ( Art.5 of the ICTY Statute-murder; inhumane acts; persecutions on political, racial and religious grounds, extermination)
- Five counts of violations of the laws and customs of war (Art.3 of the ICTY Statute-murder; attacks against civilians).
The case is currently at the preparatory stage. The Accused was granted provisional release on 9 June 2005, and must remain within the territorial limits of the municipality of Belgrade (Serbia) in accordance with the conditions set by the Tribunal.
The trial began on 2 October 2008 with the Opening Statements by the Prosecution.
