Naser Oric was officially indicted by the Prosecutor of the ICTY on 28 March 2003, was arrested by the SFOR on 10 April 2003 and transferred to the ICTY (International Criminal Tribunal for the former Yugoslavia) on 11 April 2003.

At his initial court appearance on 15 April 2003, Naser Oric pleaded not guilty on all counts.

Naser Oric is being prosecuted on the grounds of his individual criminal responsibility (Art. 7 § 1 ICTY Statute) on two counts of violations of the laws and customs of war (Art. 3 ICTY Statute), these being:
- wanton destruction of towns and villages not justified by military needs;
- looting of public and private belongings.

Naser Oric is also being tried on the basis of his criminal responsibility as hierarchical superior (Art 7 § 3 ICTY Statute) on 4 counts of violations of the laws and customs of war for:
- murder
- cruel treatment
- wanton destruction of towns and villages not justified by military needs
- pillage of public and private belongings.

His trial opened on 6 October 2004 before the ICTY.

On June 30, Naser Oric was convicted by the ICTY of failing to prevent men under his command killing and mistreating Bosnian Serb prisoners.

He was sentenced to two years in jail, but has immediatly been set free, since he already had spent three years behind bars.

An appeal was lodged by the Prosecutor and Oric.

On 3 July 2008 the Appeals Chamber reversed the decision of the Trial Chamber and found Oric not guilty.
