After a long period on the run, Radovan Karadzic was arrested in Belgrade on 21 July 2008 and transferred to the ICTY (International Criminal Tribunal for the former Yugoslavia) on 30 July 2008.

The first Indictment against Radovan Karadzic and Radko Mladic (See”related cases”) was filed on 24 July 1995 by the prosecutor of the ICTY and confirmed by judge Jorda on 25 July. It accused Radovan Karadzic and Radko Mladic of genocide, crimes against humanity, serious breaches of the Geneva Conventions and violations of the laws and customs of war.

A second indictment was then filed on 14 November 1995 and confirmed on 16 November by judge Riad. It alleged that Radovan Karadzic and Ratko Mladic were responsible for the serious breaches of humanitarian law committed by the Bosnian Serb forces during the siege and capture of the security zones in Srebrenica in July 1995. This indictment included charges of genocide, crimes against humanity, grave breaches of the Geneva Conventions and violations of the laws and customs of war.

As a result of these accusations, arrest warrants were issued and sent to the FRY, to the Republic of Bosnia Herzegovina and to the Serbian Administration of Bosnia in Pale. By June 1996 both the accused had still not been arrested. Therefore in conformity with the procedure as provided under Art.61. of the Tribunal’s rules governing procedures and the provision of evidence, the judges ordered a review of the Indictment by a first instance court. Hearings were held between June and July 1996 and the court of first instance summoned the Tribunal to add to the count of genocide, based on Art. 7. §.3.ICTY Statute, another charge based on personal responsibility by virtue of Art.7. §.1. ICTY Statute.

In the amended Indictment, Radovan Karadzic is being prosecuted on the basis of his individual criminal responsibility and/or on the basis of his criminal responsibility, as hierarchical superior, for genocide, complicity in genocide, crimes against humanity, violations of the laws and customs of war and serious breaches of the Geneva Conventions.

On 21 July 2008, government sources in Belgrade announced that Radovan Karadzic had been arrested and brought before an investigative judge of the War Crimes Court in Belgrade, in accordance with the law on cooperation with the International Criminal Tribunal for the former Yugoslavia.

On 30 July 2008, Karadzic was transferred to the ICTY in The Hague.

His initial appearance before the pre-trial judge took place on 31 July 2008.

At a second court appearance on 29 August 2008, he refused to enter either a guilty or not guilty plea. As the tribunal’s rules require that a plea must be entered within 30 days of the initial appearance of the accused, the pre-trial judge entered a not guilty plea to all charges in the indictment on Karadzic’s behalf.

On 22 September 2008, the Prosecution filed a motion to modify the first amended indictment.

The trial began on 26 October 2009 with the opening statements by the prosecution. Claiming that he had not had enough time to prepare his defense, Karadzic announced he would boycott the trial and failled to appear on the 26th.

On 5 November 2009, the Trial Chamber decided a stay of the proceedings until 1 March 2010 and, on 20 November 2009, appointed Karadzic a lawyer to represent him if he continues to boycott his trial in March.
Karadzic twice appealed against this decision but the appeals were dismissed on 24 December 2009.

In his opening statements on 1 March 2010, Karadzic denied any plans to expel Muslims from Serbia and blamed Western and Muslim States for triggering the Bosnian war. The following day, he denied the occurence of the crimes he is hold responsible for, including the four years occupation of Sarajevo and the massacre of Srebrenica, which he qualified as a "myth". Furthermore, Karadzic requested a longer delay to prepare his defense by lodging an appeal against the decision rendered in October 2009 which had granted three and a half more more months.
