A first Indictment was filed on 24 July 1995, and confirmed by Judge Jorda the following day. It accused both Radovan Karadzic (see "related cases") and Ratko Mladic of genocide, crimes against humanity and violations of the laws and customs of war. The Indictment alleged that Ratko Mladic, the former commander of the Bosnian Serb forces in Bosnia-Herzegovina, was responsible for the serious breaches of international humanitarian law committed by the Bosnian Serb forces during the period between May 1992 and July 1995.

A second Indictment was then filed on the 15 November 1995 by the Prosecutor of the ICTY and confirmed on the 16 November by Judge Riad. It alleged that Radovan Karadzic and Ratko Mladic were responsible for the serious breaches of humanitarian law committed by the Bosnian Serb forces during the “siege” and capture of the security zones in Srebrenica in July 1995. This Count of Indictment included the charges of genocide, crimes against humanity, grave breaches of the Geneva Conventions and violations of the laws and customs of war.

Following on these accusations, arrest warrants were issued and sent to the Federal Republic of Yugoslavia, to the Republic of Bosnia Herzegovina and to the Serbian Administration of Bosnia in Pale. By June 1996 both the accused had still not having been arrested, and in conformity with the procedure as provided under Art.61. of the Tribunal’s rules governing Rules of Procedure and Evidence , the judges ordered a review of the Indictment by a Trial Chamber . Hearings were held between June and July 1996 and the Trial Chamber requested the Tribunal to add to the Indictment on genocide, (based on Art. 7 § 3. ICTY Statute), the accusation of responsibility by virtue of Art. 7 § 1. ICTY Statute.

On 11 October 2002, an amendment to the two Indictments against Mladic was requested by the Prosecutor. The amended Indictment was confirmed by Judge Alphons Orie on 8 November 2002.

Ratko Mladic is still at large and being sought by the ICTY. At the end of the year 2009, the European Union announced it would delay the negotiations of Serbia's accession until Mladic was arrested.
