On 19 May 2001, Siméon Nchamihigo was arrested in Tanzania.

On 29 June 2001, the Prosecutor of the ICTR indicted Siméon Nchamihigo on five counts. He has to answer for:

- Genocide; complicity in genocide
- Crimes against humanity: assassination and extermination
- War crimes: Violence to life, health and physical or mental well being of persons, in particular murder, cruel treatment such as torture, mutilation, or any kind of physical maltreatment.

In June 2001, Siméon Nchamihigo pleaded not guilty to all charges at his initial appearance.

His trial began on 25 September 2006.

The closing arguments by the Defence and Prosecution were held in January 2008.

On 24 September 2008, the Trial Chamber of the ICTR found Nchamihigo guilty of genocide, extermination, murder and other inhumane act as crimes against humanity and sentenced him to life inprisonment.

In sentencing Nchamihigo, the Trial Chamber took into account in particular that he committed the crimes despite his position as a Rwandan prosecutor

His lawyers announced that he will appeal the judgement.
