| | | | Stojan Zupljanin was arrested near Belgrade on 11 June 2008.
Already in December 1999 the International Criminal Tribunal for the former Yugoslavia (ICTY) had issued an indictment against Zupljanin.
Under the terms of the indictment, Stojan Zupljanin was charged on the basis of his individual criminal responsibility (Art. 7 § 1 ICTY Statute) and on the basis of his criminal responsibility as hierarchical superior (Art. 7 § 3 ICTY Statute) for:
Two counts of genocide (Art. 4 ICTY Statute):
- genocide and complicity in genocide.
Five counts of crimes against humanity (Art. 5 ICTY Statute):
- persecutions
- extermination
- torture
- expulsion
- inhumane acts (forcible transfer).
Two counts of violations of the laws or customs of war (Art. 3 ICTY Statute):

-destruction or wilful damage done to institutions dedicated to religion.
Three counts of serious violations of the Geneva Conventions of 1949 (Art. 2 ICTY Statute):

- the appropriation or plunder of property not justified by military necessity and carried out on a large scale and in an illicit and arbitrary manner.
Following the indictment, an international arrest warrant was issued against him.
Zupljanin was considered to be in hiding somewhere in the territory of Bosnia and Herzegovina. Following a decision by the local authorities, his property was frozen, and the names of his close family members and friends were blacklisted. No indictments however were filed against them, despite the fact that supporting ICTY fugitives is considered to be a criminal offence in Bosnia and Herzegovina.
Zupljanin was arrested on 11 June 2008 near Belgrade and taken to the detention unit of the Belgrade Special War Crimes Court. He was transferred to the ICTY in The Hague on 21 June 2008.
His initial appearance before the ICTY Trial Chamber took place on 23 June 2008. He pleaded not guilty to all charges on 21 July 2008.
On 23 September 2008, the Trial Chamber granted the Prosecution motion to combine the cases of Mico Stanisic and Stojan Zupljanin.
The Prosecution filed an amended joinder indictment on 29 September 2008. On 20 November 2008 Zupljanin pleaded not guilty to all charges in the consolidated joinder indictment. | | | | Trial Watch would like to remind its users that any person charged by national or international authorities is presumed innocent until proven guilty. | | | | | nationality : | | | Bosnia and herzegovina | | | date of birth : | | | 22.09.1951 | | | last time seen : | | | The Hague, Netherlands | | | period of charges : | | | 04.1992 - 12.1992 | | | judgement period : | | | 14.09.2009 | | | charges : | | | Crimes against humanity Genocide Torture War crimes | | | profile last modified : | | | 10.02.2010 |
