facts legal procedure
In December 1999 the International Criminal Tribunal for the former Yugoslavia (ICTY) issued an indictment against Zupljanin.

Under the terms of the indictment, Stojan Zupljanin is charged on the basis of his individual criminal responsibility (Art. 7 § 1 ICTY Statute) and on the basis of his criminal responsibility as hierarchical superior (Art. 7 § 3 ICTY Statute) for:

Two counts of genocide (Art. 4 ICTY Statute):
- genocide and complicity in genocide.

Five counts of crimes against humanity (Art. 5 ICTY Statute):
- persecutions
- extermination
- torture
- expulsion
- inhumane acts (forcible transfer).

Two counts of violations of the laws or customs of war (Art. 3 ICTY Statute):
-wanton destruction or devastation of towns or villages not justified by military necessity,
-destruction or wilful damage done to institutions dedicated to religion.

Three counts of serious violations of the Geneva Conventions of 1949 (Art. 2 ICTY Statute):
- wilful murder,
- torture,
- the appropriation or plunder of property not justified by military necessity and carried out on a large scale and in an illicit and arbitrary manner.

Following the indictment, an international arrrest warrant was issued against him.

It was supposed that Zupljanin is hiding on the territory of Bosnia and Herzegovina. As per a decision made by the local institutions, his property was frozen, while the names of his close family members and friends wer blacklisted, although no indictments were filed against them, despite the fact that supporting ICTY fugitives is considered as a criminal offence in Bosnia and Herzegovina.

Zupljanin was arrested on 11 June 2008 near Belgrade and brought to the detention unit of the Belgrade Special War Crimes Court. He was transferred to the ICTY in The Hague on 21 June 2008.

His initial appearance before the ICTY Trial Chamber took place on 23 June 2008. He pleaded not guilty on all the charges on 21 July 2008.

On 23 September 2008, the Trial Chamber granted the Prosecution’s motion to join the cases of Mico Stanisic and Stojan Zupljanin.

The Prosecution filed an amended joindered indictment on 29 September 2008. The accused Stanisic and Zupljanin will be given the opportunity to enter a plea on the new charges in a further initial appearance.
