On July 18 2007, prosecutors for the Extraordinary Chambers in the Courts of Cambodia (ECCC, see ‘spotlight’) announced that they had delivered the files of five suspects susceptible of being tried for genocide, war crimes, and crimes against humanity to the Chambers. The co-investigating judges of the ECCC are currently examining the files.

The prosecutors stated that Ieng Thirith is believed to have participated in the "planning, direction, coordination and ordering of widespread purges (...) and the unlawful killing or murder of staff members from within the Ministry of Social Affairs".

On November 12, 2007 Ieng Thirith was arrested along with her husband, Ieng Sary, on a warrant issued by the Co-Investigating Judges of the ECCC that charges her with crimes against humanity. She was placed in provisional detention at the ECCC’s prison in Phnom Penh.

The pre-trial hearing of her appeal against provisional detention took place on 21 May 2008.
