The Prosecutor’s Office applied to the Court of Bosnia and Herzegovina for a custody order on 8th April 2008 on the grounds of an alleged risk that Vaso Todorovic would hinder the criminal proceedings.

Vaso Todorovic is accused of participation in the genocide of 1,000 Bosnian Muslim men in Srebrenica during the period 10th July 1995 to 19th July 1995.He is also accused of participation in the joint criminal action of forced relocation of 25,000 Bosnian Muslim women, children and elderly persons on 12th July 1995 and 13 July 1995.

The Court found that there was “grounded suspicion that the Suspect had committee the criminal offence in question”. Accordingly the Court of Bosnia and Herzegovina issued a one-month custody order on 8th April 2008. The Court based its decision on a number of grounds. Firstly, that the circumstances suggest a possibility of flight. Secondly, that Vaso Todorovic may "hinder the criminal proceedings by influencing witnesses, accessories, or accomplices." Finally, the Court took into account the nature of the genocide offence that Vaso Todorovic is suspected of, and ordered custody on the basis of public and property security.

On 17 September 2008, Vaso Todorovic pleaded not guilty to the indictment for genocide.

On 22 October 2008, following the acceptance of a guilt admission agreement, the State Prosecution amended the indictment, qualifying the crime as crime against humanity.

Vaso Todorovic was sentenced to six years' imprisonment for crimes against humanity committed in the Srebrenica area in July 1995.

The verdict pronounced Todorovic guilty, as member of the Second Special Police Squad from Sekovici, with having helped in the murder of several thousand Srebrenica residents in Kravica and the forcible resettlement of women and children from Srebrenica during the course of the armed conflict, from July 10 to July 19, 1995.

This guilt admission agreement is the sixth agreement, accepted by the State Court at war crime trials.
