Vincent Rutaganira surrendered voluntarily to investigators from the Chief Prosecutor of the ICTR on 4 March 2002 in Kigoma, Tanzania. On the same day, he was transferred to the prison quarters of the United Nations in Arusha, Tanzania, where he is in detention awaiting trial.

At his initial court appearance, on 26 March 2002, Rutaganira pleaded not guilty to all the charges for which he was indicted.

According to the Count of Indictment, dated 26 April 1996, Rutaganira was charged on seven counts. He was accused of genocide, conspiracy to commit genocide, murder, extermination and other inhumane acts, serious violations of Article 3 Common to the Geneva Convention and serious violations of Additional Protocol II.

On 8 December 2004, Rutaganira pleaded guilty of complicity, by omission, to the extermination of Tutsis in his home town and asked for forgiveness before the Third Chamber, thereby becoming the forth person to make a confession before the ICTR. He took this line of defence following an agreement reached during the night of 7-8 December 2004 with the Chief prosecutor of the ICTR in return for which the Chief Prosecutor agreed to proceed only with the aforementioned Count of Indictment. In addition, the Chief Prosecutor pledged to requisition a reduced sentence of only 6-8 years in prison.

A hearing, dedicated mainly to presentation of the mitigating circumstances took place on 17 January 2005.

On 14 March 2005, the Trial Chamber sentenced Vincent Rutaganira to six years in prison. At the time, this sentence was the shortest ever imposed by the court, which took into account his voluntary surrender, his ill health and his advanced age in reaching its decision. Rutaganira also received a deduction for time already served after his 2002 arrest.

He was released on 2 March 2008.
