Zdravko Tolimir was arrested by Bosnian Serb police on 31 May 2007 in Banja Luka and the following day he was transferred to the International Criminal Tribunal for the former Yugoslavia (ICTY).

On 10 February 2005, the ICTY had confirmed an indictment against Zdravko Tolimir.

The indictment charged him on the basis of his individual criminal responsibility (Article 7 § 1 ICTY Statute) with:
- genocide;
- conspiracy to commit genocide;
- extermination (as a crime against humanity);
- murder (as a crime against humanity);
- murder (as a violation of the laws and customs of war);
- persecutions on political, racial and religious grounds (as a crime against humanity);
- forcible transfer (inhumane act, as a crime against humanity);
- deportation (as a crime against humanity).

On 21 September 2005, following the Prosecutor’s demand, the ICTY judges agreed to join the 9 cases linked to Srebrenica’s massacre under the case name Popovic et al. The nine accused – Ljubisa Beara, Ljubomir Borovcanin, Milan Gvero, Radivoje Miletic, Drago Nikolic, Vinko Pandurevic, Vujadin Popovic, Zdravko Tolimir and Milorad Trbic (see “related cases”) – are all senior Bosnian Serb army, VRS, and police officers. The trial against Popovic et al. began on 14 July 2006.

On 31 October 2005, the Tribunal accepted to add the charge of genocide to the amended and consolidated indictment dated 28 June 2005.

On 13 July 2006 the Trial Chamber requested that the charges against Zdravko Tolimir be removed from the indictment. Subsequently the Prosecutor filed the revised second consolidated amended indictment on 4 August 2006, which no longer included charges against Trbic or Tolimir. On 15 August 2006, the Trial Chamber officially severed Zdravko Tolimir from the case and ordered a new indictment against him to be filed.

The case against Tolimir was assigned a new case number and on 28 August 2006 the Prosecution filed the operative indictment against him only.

Zdravko Tolimir was arrested by Bosnian Serb police on 31 May 2007 and the following day he was transferred to the ICTY.

At his first appearance before the Tribunal, Tolimir said he wished to represent himself, but declined to enter a plea, or state his name, or his place and date of birth.

Following a second refusal to enter a guilty or not guilty plea to the charges, the judges considered that this was tantamount to a declaration of not guilty.

Tolimir also challenged the legality of his arrest and accused the ICTY of barring him from obtaining his preferred counsel who was, at the time, serving another defendant.

The trial began on 26 February 2010.
