| | | | The proceedings initiated against Augusto Pinochet in Chile are interesting for different reasons. In particular, the transition towards a democratic regime, the independence of the judiciary and national reconciliation were all interests that were at stake in the Chilean Pinochet Case.
Furthermore, the use of the "ongoing offence" doctrine to qualify the crime of disappearance allowed circumvention of the application of the 1978 Amnesty Law. This law has not yet been abolished although Chile has been the subject of comments from the Human Rights Committee, the Committee against Torture and the Inter-American Commission on Human Rights.
