 | | | | Charles Taylor | | | context : | Sierra Leone | | judgement place : | Sierra Leone Special Court | | status : | On trial | | particulars : | Transferred to the Special Court for Sierra Leone on 29 March 2006; pleaded not guilty on 3 April 2006; trial in The Hague began on 4 June 2007; trial resumed on 7 January 2008 | | position : | President of Liberia | |
| | | | On 31 May 2004, the Special Court for Sierra Leone rejected the preliminary motion filed by Charles Taylor. He had claimed that as the president of Liberia at the time of the relevant facts, he enjoyed the immunity of a head of State and that consequently, his accusation by the Court was illegal.
The Court stated that the principle of non-interference in the affairs of another State does not prevent the criminal prosecution of a head of State by an international criminal tribunal such as the one set up in Sierra Leone.
Invoking the precedents of the Nuremberg and Tokyo Charters, and the statutes of the ad-hoc tribunals for the former Yugoslavia and Rwanda, it further held that the immunity of heads of States does not extend to crimes against humanity and war crimes. | | | | | | | nationality : | | | Liberia | | | date of birth : | | | 28.01.1948 | | | last time seen : | | | The Hague (Netherlands) | | | period of charges : | | | 30.11.1996 | | | judgement period : | | | 04.06.2007 | | | charges : | | | Crimes against humanity War crimes | | | profile last modified : | | | 07.01.2008 |
