|  | |  | Fulgence Kayishema was first charged in 1998 by the Specialized Chamber of the First Instance Tribunal of Kibuye for the same acts. This procedure, Public Minister and civil parties v. Nkinamubanzi Anastase and Consorts, led to a judgement by the Chamber on the 17th of April 1998. It declared that the public action against Fulgence Kayishema was disjointed from the procedure before the court. His trial was deferred to a future “regular summons.” However, no other procedure was later taken up against Fulgence Kayishema within the Tribunal’s framework.
CASE REFERRALS BY THE ICTR
The transfer of certain accused before the national jurisdictions, including those of Rwanda, is part of the ICTR’s completion strategy. The ICTR is scheduled to end its first instance trials by the end 2008.
One of the conditions imposed by the ICTR for transferring the accused before the Rwandan legal system was the abolition of the death penalty in Rwanda, for all crimes including those of genocide.
