Germain Katanga is the second person in the custody of the International Criminal Court (ICC), following the arrest of Thomas Lubanga Dyilo (see “related cases”), the alleged founder and leader of the Union of Congolese Patriots (UPC), on 28 August 2006. On 6 February 2008, a third person, Mathieu Ngudjolo Chui (see "related cases"), the former head of the FNI and colonel with Democratic Republic Congo's government troops, was arrested and transferred to The Hague. The Pre-Trial Chamber is currently considering the issue of joining the charges against Mathieu Ngudjolo Chui and Germain Katanga.

The Prosecutor of the ICC initiated investigations in the Democratic Republic of the Congo in June 2004 after the Congolese Government referred the situation in the country to the Court. The situation in the DRC is one of four situations currently investigated by the Office of the Prosecutor. The other three situations are: the situation in Uganda and the situation in Darfur (Sudan), where arrest warrants have been issued; and the situation in the Central African Republic where an investigation is ongoing.
