Investigations into the events of February 2003 and the circumstances surrounding the resultant deaths were initiated by the civilian authorities.

Faced with regular changes of prosecutor, and the slowness of the investigation, a group of non-governmental human rights organisations set up a commission to follow up on the death of the nurse Ana Colque Quispe and a lawyer is appointed to file a criminal suit.

At the end of May, Ana Colque Quispe’s mother initiated criminal proceedings in connection with her daughter’s murder.

In August 2003, the formal indictment is presented by the prosecutors. This charged four members of the army with homicide, grievous bodily harm and assault.

The military personnel against whom these charges were brought claimed lack of competence on the part of the civilian courts, stating they should be tried under military justice.

On 30 August 2003 the Criminal Court established that the case ought to proceed before civilian jurisdiction.

On 2 October 2003, the Superior Court of the District of La Paz rejected the competence of the civilian authorities.

The plaintiff appealed against this decision but the case remained with the Military Court which, in February 2004, acquitted the four soldiers.

However, in May 2004, the Constitutional Court, in response to an appeal lodged by Ana Colque Quispe’s mother, decided that the four soldiers ought to be tried by the ordinary courts. No appeal against this decision is possible.
