The Radovan Stankovic case is notable for being the first case handed down by the International criminal tribunal for the former Yugoslavia (ICTY) to a national jurisdiction in application of Article 11bis of the ICTY Rules of Procedure and Evidence.

This landmark decision by the ICTY comes within the framework of its strategy to conclude its activities by 2010.

On 9 March 2005, the State Court of Bosnia-Herzegovina inaugurated a special Chamber dedicated solely to trying war criminals. This court is currently composed of both foreign and Bosnian magistrates. However, within 5 years from inauguration, the foreign magistrates were to be replaced by Bosnians.
