| | | | La décision de la Chambre de Première Instance souligne le caractère de jus cogens de l'interdiction du génocide et définit la complicité pour génocide:
- L'interdiction du génocide est une norme de jus cogens:
“Article 4(2) and (3) of the Statute reproduce verbatim Article II and III of the Convention on the Prevention and Punishment of the Crime of Genocide adopted on 9 December 1948 (‘Genocide Convention’). It is widely recognised that the law set out in the Convention reflect customary international law and that the norm prohibiting genocide constitutes jus cogens.” (Blagojevic and Jokic, Chambre de première instance, 17 janvier 2005, §639).
- Définition de la complicité pour génocide:
“The Appeals Chamber has acknowledged that complicity in genocide includes the notion of aiding and abetting in the planning, preparation or execution of a crime, as well as other forms of liability.
